Terms of Service

These Terms of Service ("Terms") govern your use of the MooringOps platform ("Service") operated by MooringOps ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
Acceptance of Terms
By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Description of Service
MooringOps is a platform for harbor authorities, mooring installers, and cove masters to manage mooring records, inspections, jobs, and related operations. Features include GPS mapping, inspection tracking, job management, CSV import/export, team collaboration, and compliance reporting.
Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. You are responsible for ensuring that all information you provide is accurate and up to date.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
- Use the Service to store or transmit unlawful, harmful, or fraudulent content.
- Attempt to gain unauthorized access to any part of the Service or its related systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service to compete with MooringOps or to build a similar product.
Data Ownership
Your organization retains full ownership of all data entered into the Service, including mooring records, contacts, inspection histories, and job records. We do not claim any ownership rights over your data. You grant us a limited license to use your data solely to operate and improve the Service.
Payment and Billing
Access to the Service requires a paid subscription. Subscription fees are billed in advance on a recurring basis according to the plan you select. You are responsible for providing accurate billing information and for paying all charges on time. We reserve the right to change subscription pricing with 30 days' notice.
Termination
You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms or if your subscription payment fails. Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days following termination, after which it will be deleted unless retention is required by law.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
Limitation of Liability
To the maximum extent permitted by law, MooringOps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Massachusetts.
